Section 46 (2) of the German Criminal Code: the protective shield for the free democratic basic order

Section 46 (2) StGB (Strafgesetzbuch, the German Criminal Code) brings precisely this distinction from “ordinary” offences to the fore through its particular sentencing criteria. For if someone is spat at for being Jewish or homosexual, that has an entirely different dimension from the same act committed without an ideologically motivated background – in the course of an argument, for example.
